Update on Overturn the Ban at Pelican Bay State Prison campaign

  • Jul 1 2010 - 1:00am

The ACLU - Foundation (Southern California), legal counsel for the PRLF regarding the ban of Revolution newspaper, sent letters in early June to two California prisons -- Pelican Bay State Prison (PBSP) and Chuckawalla Valley State Prison (CVSP) -- saying if they did not lift their blanket bans on Revolution and permit its distribution to prisoners, the ACLU would discuss with PRLF future options, including litigation. Both of these California prisons had officially notified RCP Publications (and thus PRLF) in February that Revolution

Questions which prison officials must be compelled to answer:

    1)       There was  a period of at least 5-6 months from October 2009 till at least May 2010, when Revolution newspaper was deemed to be "contraband" and was NOT delivered to any of the over 45 prisoner subscribers at PBSP.  PRLF has a mountain of evidence that there was such a ban.  The prison officials now say, "no ban is in effect" trying to  avoid accountability for what they did and said for many months.  The prison officials must bring to light everything that has been going on over this whole period of time and what are their justifications for it.

As I wrote in my last newsletter, PRLF legal counsel, the ACLU Foundation of Southern California, has sent letters to prison authorities demanding all documents related to the ban, as well as making a strong case that there is no legal basis for the ban. There are important new signatories to the Statement to Overturn the Ban. In response to these kinds of salvos on the legal and political fronts, prison authorities at Pelican Bay State Prison have been forced to  maneuver, even denying that there is a ban, trying to cover up and continue the ban at the same time (see article in Revolution). As the article says, it is TIME TO STEP UP AND MAKE THIS A BIG DEAL SO THE BAN IS OVERTURNED, THE REASONS FOR IT MADE PUBLIC AND SO IT CAN'T BE REINSTATED IN ANY FORM!

I'm writing to let you know about two very significant developments in the struggle to overturn the ban of Revolution newspaper at Pelican Bay and Chuckawalla State Prisons in California and all prisons.

  • May 26 2010 - 1:00am

In February 2010, Revolution newspaper was banned at California's Pelican Bay State Prison and Chuckawalla State Prison. Announcing this ban, prison authorities stated, "The Publication Revolution is ban (sic) from all institutions within the state of California. Please remove all inmates from your mailing list", and further alleged that, "your periodical newspaper has been determined to be contraband because it 'promotes disruption and overthrow of the government and incites violence to do so'... ", and further, that the newspaper "incites racial violence and promotes governmental anarchy."

I am the new director of the Prisoners Revolutionary Literature Fund (PRLF). Normally, I would introduce myself here. But I would really like you to meet the prisoners who write us every week. If you have not done so already, take a few minutes to read even just one of these letters from a prisoner. No matter what you think you already know, you WILL be surprised...
